For clarity as far as I’m concerned I have been bringing a Judicial Review against smart motorways for over 4 years.

A Judicial Review request must be lodged within 6 months of an action (in this case, smart motorways being implemented) naturally because smart motorways were sneaked in on the quiet, so the public couldn’t object to what they don’t know about, I missed that deadline by about 14 years!
So in order to bring a judicial review at this stage there are several stages you have to go through before you actually get into court, National Highways know this and that is why they are stalling, they know exactly what SMK and Irwin Mitchel need to happen to comply with the rules of the judicial review process and they are making sure we don’t get it. They have delayed us at every stage, at one point we even had to threaten legal action for failure to respond!
National Highways are slow timing us, stalling, offering compromises, paying even more of the taxpayers money to other organisations to read the very expensive reports we had to provide, and seemingly hoping we will just give up and go away eventually.
Note to National Highways: I will fight this as long as my husband is dead!
