Freedom of Information request (FoI) to National Highways to see if they have sneaked through another policy change on the quiet again.

I have been sent this video (click image below) and others similar multiple times over the weekend. I will be doing a Freedom of Information request (FoI) to National Highways to see if they really have sneaked through yet another massive policy change on the quiet again.

Please do not blame the Control Room Operators they have to work with a system that doesn’t work, unsafe staffing levels and management hell bent on dodging responsibility and maximising profits for a privatised dept of the government

We tried to push for corporate manslaughter charges against National Highways and understandably the Crown Prosecution Service took legal advice to see if the case was a viable use of public funds. The legal advisors ruled the NH didn’t owe the motorist a Duty of Care, so a case against NH was not advised to proceed.

Interesting fact: The CPS shares governmental resources, including legal advisors! So the same legal advisors that formed the decision that NH shouldn’t face charges are also legal advisors for National Highways!!

So this decision meant we could not pursue them with criminal law. Unfortunately, it also means that civil action has now effectively been made impossible too, due to the legal decision we can find no lawyers to take our civil actions on a No-Win-No-Fee basis.

Legal Aid for this wouldnt be approved either (for same reason) so that decision by what is effectively National Highways own legal department prevents us from criminal or civil legal action.

So long story short, National Highways can continue to put all motorists at massively increased risk and face absolutely no consequences! And as seen in the previous post they will continue to cut measure after measure to scale back on safety even more, citing capacity, economic costs (an assigned arbitrary figure that changes depending on its application) and blaming the motorist at every opportunity, while never mentioning how more refuge areas doesn’t allow emergency vehicle through.

Please Note: I have tried all avenues to get legal representations, I have tried public appeals, the law society, legal training organisations, famous lawyers who have shown support for our cause, famous personalities, etc, etc, etc, if you can suggest it then over the last 5 years I have tried it.

Crowd funding doesn’t seem to work, we’ve been doing that for 5 years and got less than a tenth of what it would cost to pay up front for this kind of action.

….. unless you are a lawyer offering your services on no-win, no-fee, 😊
