Using a Freedom of Information (FOI) request I asked the following.
I know statutory recovery’s are not new btw, but they are a lot more frequent on smart motorways because of the increased hazard posed by no hard shoulder, So its amazing to me that:
* you are forced to accept National Highways decide if you need immediate removal
* they decide who removes your vehicle
*they will charge for this (even if you have breakdown cover you still need to pay the extra £150 minimum fee)
*and if you dont/cant pay they will hold your vehicle ransom and add storage costs the charge!
All because they have put you in a situation so dangerous, imminent removal is needed!!
***So they put you in increased danger and charge you for it!***
