for manslaughter, but its an up hill battle.
We have received a copy of a letter today to Sarah Champion (my mp) who is trying to fight our corner. The letter states that (1) there’s no fault with smart motorways & (2) the Health and Safety Executive are investigating the mater.
It just completely ignores the fact that the lane wasn’t closed until after Jason and Alexandru were killed! That’s a pretty big fault I think!
Also the fact there is no hard shoulder has been a very publicly discussed problem for many years.
SYP, the Chief of SYP, the Leader of the Police Federation, the SY Police & Crime Commissioner, etc, etc have all been very publicly, very critical of smart motorways, how can SYP now say there is no flaw with the system?
Also ignored is HSE confirmed 4 weeks ago now that they have no jurisdiction (and never have) to look into complaints of corporate manslaughter. SYP have just dumped it on someone else’s desk so they can just keep saying ‘it’s with them now’ ignoring the fact they have dumped it on the wrong organisation. I’ve have an email from the HSE. which explains in clear English just how wrong the referral to HSE was and HSE were very surprised that it happened at all and commentating that it shows the police “may need more training in their understanding of the HSE’s role”
